These Terms of Service ("Terms") are a binding agreement between you and WOD Capital LLC, an Ohio limited liability company ("WOD," "we," "us," or "our"), governing your access to and use of this website, our Discord community, and any related giveaways, referral programs, or content we operate (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
By creating an account, connecting Discord, submitting an order number, entering a giveaway, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and — where applicable — our Official Giveaway Rules, which are incorporated into these Terms by reference.
You must be at least 18 years old and capable of forming a binding contract under applicable law to use the Service. By using the Service, you represent that you meet these requirements. We do not knowingly allow anyone under 18 to create an account, join giveaways, or submit personal information to us.
WOD operates an online community and content platform focused on futures/proprietary-firm ("prop firm") trading education and discount codes. The Service includes, without limitation: this website, a Discord server, informational and promotional content, discount/referral codes for third-party prop firms, a referral program, and periodic giveaways of prop-firm evaluation accounts. WOD is a media and marketing business — WOD is not a prop trading firm, broker-dealer, futures commission merchant, or investment adviser, and does not itself sell trading accounts, execute trades, or hold customer funds.
Nothing on the Service is, or should be construed as, financial, investment, trading, tax, or legal advice. All content — including videos, posts, Discord messages, livestreams, and this website — is provided for general educational and informational purposes only. WOD is not a registered investment adviser, broker-dealer, or Commodity Trading Advisor, and no content constitutes a recommendation or solicitation to buy or sell any security, futures contract, or financial instrument.
Trading futures, forex, and other leveraged instruments — including through simulated or "evaluation" prop-firm accounts — carries a substantial risk of loss and is not suitable for every person. Past performance, including any results shown or discussed by WOD or its community members, is not indicative of future results. You are solely responsible for your own trading and financial decisions, and you should consult a licensed financial professional before making any trading or investment decision.
WOD participates in referral/affiliate programs with third-party prop trading firms (including, without limitation, Lucid Trading, Tradeify, and Alpha Futures). When you use a WOD discount code (e.g. "WOD") or click a WOD referral link to purchase an evaluation account from one of these partners, WOD may receive a commission or other compensation from that firm, at no additional cost to you. This creates a financial incentive for WOD to promote these partners, which you should factor in when evaluating any content, review, or recommendation on the Service. WOD only partners with firms it has independently chosen to work with, and this disclosure applies to all such partnerships across the Service, including the Prop Firms page and referral materials.
From time to time, WOD conducts giveaways of prop-firm evaluation accounts. All giveaways are governed by our separate Official Giveaway Rules, which control in the event of any conflict with these Terms. No purchase is necessary to enter or win any giveaway — see the Official Giveaway Rules for the free method of entry.
WOD's referral program allows an existing member to earn an additional giveaway entry when someone they refer completes a qualifying purchase using code WOD. Each unique person may only be referred once; self-referrals, fake accounts, and any attempt to manufacture referrals are prohibited and will void the associated entries and may result in disqualification from future giveaways.
You agree not to: (a) create multiple accounts, use bots, scripts, or automated means to generate entries, referrals, or engagement; (b) submit false, fraudulent, or manipulated order numbers or purchase information; (c) impersonate any person or entity; (d) harass, threaten, or abuse other members of the community; (e) attempt to interfere with, disrupt, or gain unauthorized access to the Service; or (f) use the Service for any unlawful purpose. Violation of this section may result in immediate removal from the Discord server, forfeiture of giveaway entries, and termination of your access to the Service.
Use of our Discord server is also subject to Discord's own Terms of Service and Community Guidelines, as well as any server-specific rules posted in the Discord itself. WOD is solely responsible for its own server and is not affiliated with, sponsored by, or endorsed by Discord Inc.
All trademarks, logos, graphics, copy, and other content on the Service (excluding third-party trademarks, such as partner prop-firm logos, which remain the property of their respective owners) are owned by or licensed to WOD Capital LLC. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
The Service contains links to independent third-party websites, including prop-firm partners and social platforms. WOD does not control and is not responsible for the content, terms, funding decisions, payout policies, availability, or practices of any third-party site. Your purchase of, or account with, any prop firm is a separate contract solely between you and that firm, governed by that firm's own terms. WOD is not a party to that contract and makes no guarantee regarding evaluation outcomes, funding, or payouts from any partner firm.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOD CAPITAL LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, TRADING LOSSES, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, ANY GIVEAWAY, ANY THIRD-PARTY PROP FIRM PRODUCT, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless WOD Capital LLC and its owners, employees, and agents from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Service (including removal from the Discord server and disqualification from giveaways) at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, third parties, or WOD.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction of those courts.
